Membership terms and conditions
  • Article 1 (Purpose)
    The purpose of this Agreement is to prescribe the conditions, procedures and other necessary matters for the use of the Internet homepage service (hereinafter referred to as the "Service") provided by SkyUp Dragon (hereinafter referred to as the "Site").

  • Article 2 (Effect and Change of Terms)

  • ① These terms and conditions will take effect by publishing them in the Service Menu and disclosing them.
  • ② The Foundation may change these terms and conditions if reasonable reasons arise, and if the terms and conditions are changed, it will be announced through a notice without delay.
  • ③ If the user does not agree to the changed terms and conditions, he/she can always stop using the service and terminate the contract. Continuous use of the service after the effective date of the terms and conditions is deemed to have been agreed by the user to change the terms and conditions.

  • Article 3 (Rules other than the Terms)
    If the terms and conditions are not specified in these terms and conditions, they shall be in accordance with the relevant laws and regulations, and if not, they shall be in accordance with general practice.

  • Article 4 (Definition of Terms)
    The terms used in this Agreement are defined as follows.
  • ① Site: It refers to a site operated to provide the foundation's services to users.
  • ② User: It refers to a member or non-member who receives services provided by the site in accordance with the Foundation's Terms and Conditions.
  • ③ Member: A person who agrees to the terms and conditions of use of the Foundation and who has been registered and approved as a member by providing personal information and can use the login service provided by the Foundation.
  • ④ Non-member: It refers to a person who uses the service provided by the site without registering as a member.
  • ⑤ ID: refers to a combination of letters and numbers that a member applies for and approves for member identification and member service use.
  • ⑥ PASSWORD: It refers to a combination of letters and numbers selected by the member himself to confirm that the member is a member who matches the ID given and to protect the member's confidentiality.
  • ⑦ Withdrawal: A member's expression of intention to terminate the use contract.
  • ⑧ Terms not defined in these terms and conditions are defined in separate terms and conditions for individual services and usage regulations.

Chapter 2 Application for Use of Services

  • Article 5 (Application for Use)

  • ① Users who wish to become members click the "Agreed" check on the membership registration page online to indicate their consent to the contents of the terms and conditions on the website.
  • ② The membership is completed through the record according to the form provided on the website, and it is established with the approval of the foundation and qualifies as a member.
  • ③ Users can select and apply for the following services on the membership screen of the site.
    - Consent to receive(E-mail / SMS)
  • ④ The Foundation may require additional information and user consent procedures required to use smooth services and user consent procedures.

  • Article 6 (Acceptance and Restriction of Application for Use)

  • ① If the Foundation applies for use by accurately stating the matters prescribed in Article 5 of Chapter 2, it shall accept the application for use of the service unless there are special circumstances.
  • ② The Foundation may not accept the application for use only in the following cases:
    - Where the requirements for membership registration set out on the website are not met;
  • ③ The Foundation may withhold applications for use or restrict the use of some services until the grounds are resolved in any of the following cases:
    - Insufficient capacity of service related facilities
    - If there are technical reasons
    - Where it is deemed necessary due to other circumstances of the Foundation;

  • Article 7 (Valid period of membership)
    The validity period of the member is from the time the application for use is established to the time when the application is terminated by the user's intention.

  • Article 8 (Service provided to members)

  • Login service provided by the foundation is available.
  • Various events and token information of the foundation can be provided through e-mail or SMS.
  • You can participate in NFT sales and airdrop events held by the foundation.

Chapter 3 Restrictions on Use of Land and Services

  • Article 9 (withdrawal of membership and loss of qualifications)

  • ① If a member wishes to withdraw his/her intention to receive services provided on the website after registering as a member, he/she may request withdrawal at any time by using the “Withdrawal of Membership” menu, and the Foundation will process the membership withdrawal immediately.
  • ② If a member falls under any of the following subparagraphs, the Foundation may restrict, suspend, or cancel membership.

  • 1. If you applied using someone else's name
  • 2. If it is found that false information was entered when registering as a member
  • 3. In the event of an act such as interfering with other people's use of the website service or stealing other people's information
  • 4. In the case of using the website to conduct acts prohibited by laws and these terms and conditions
  • 5. When an application is made for the purpose of undermining social well-being or good morals

  • Article 10 (change of member information)

  • ① Members can view and modify their information at any time through member information management. However, the real name and ID required for service management cannot be modified.
  • ② When a member changes the information entered when applying for use, he or she must make the change online or notify the Foundation of the change by e-mail or other means.
  • ③ The Foundation is not responsible for any disadvantages caused by not notifying the Foundation of the changes in Paragraph 2.

Chapter 4 Obligations of Service Providers

  • Article 11 (Personal Information Protection)

  • ① When registering as a member, the Foundation collects the minimum information necessary to provide member services.
  • ② The Foundation must obtain the consent of the user when collecting personally identifiable information of the member. (If the member himself/herself fills out the application form after reading the website terms of use and clicking the “I Agree” button, it is deemed to have agreed to these terms and conditions.)
  • ③ Provided personal information cannot be used without the member's consent, except in the following cases, and is not provided to third parties.
    - When there is a request from the relevant agency for the purpose of investigation according to the relevant laws and regulations
    - When there is a request from the Information and Communication Ethics Committee
    - When there is a request in accordance with the procedures stipulated in other related laws
  • ④ Information modified by a member, such as withdrawal of consent for membership registration, request for reading or correction, etc., will be applied immediately from the time the modification procedure is completed.
  • ⑤ When the purpose of collection or provision of personal information is achieved, the personal information is immediately destroyed. However, an exception is made when it is necessary to preserve it according to the provisions of laws and regulations.
  • ⑥ The Foundation has opened a window to receive opinions and complaints from users regarding personal information protection. If you have any complaints regarding personal information, please give your opinion to the person in charge of personal information protection or the person in charge of personal information protection, and we will take action immediately upon receipt and notify you of the result.

  • Article 12 (Obligations of the Foundation)

  • ① The Foundation shall not engage in acts prohibited by laws and these Terms and Conditions or contrary to public order and morals, and shall do its best to provide services continuously and stably as stipulated in these Terms and Conditions.
  • ② The Foundation is obliged to do its best for the security of users' information by taking the best safety measures for the security of users' personal information so that users can safely use the service.
  • ③ If the Foundation deems it justified for any inconvenience or complaint raised by a member, it must be dealt with immediately.

  • Article 13 (Responsibilities of Members)

  • ① Members must comply with the matters notified by the Foundation, such as related laws and regulations, the provisions of these Terms and Conditions, and usage guidelines, and must not engage in any other acts that interfere with the Foundation.
  • ② You are responsible for maintaining the confidentiality of the information you enter from the moment the applicant completes the Foundation service subscription process, and the member is responsible for any consequences arising from the use of the member's Internet ID and password.
  • ③ Members are responsible for managing information necessary to use the service, such as ID and password. The Foundation is not responsible for information lost due to the member's negligence.
  • ④ Members must not engage in any of the following acts in connection with the use of the service.

  • 1. Reproduction of information obtained from the service for purposes other than the use of members without prior consent of the Foundation, use of it for publication and broadcasting, or providing it to a third party
  • 2. Acts that infringe on other rights such as copyright of the foundation and copyright of third parties
  • 3. The act of registering or distributing computer virus infection data that causes malfunction of information and communication facilities, destruction of information, etc.
  • 4. An act that is objectively judged to be related to a crime
  • 5. Acts that damage the reputation of the Foundation or other third parties or interfere with their work
  • 6. The act of disclosing or posting obscene or violent messages, images, voices, and other information that goes against public order and morals on the service
  • 7. Acts that violate other related laws or the conditions of use set by the foundation

  • Article 14 (Notice to Members)

  • ① If the Foundation notifies members, it can be done by e-mail address or SMS text message within the service, unless otherwise specified in these terms and conditions.
  • ② In the case of notification to all members, the Foundation may replace the notice in Paragraph 1 by posting it on the bulletin board of the foundation website for more than 7 days.

Chapter 5 Use of Services

  • Article 15 (Provision of Information)

  • ① In principle, the services provided by the Foundation to members are provided 24 hours a day, 365 days a year.
  • ② The Foundation may temporarily suspend the provision of services in the event of maintenance, replacement or breakdown of information and communication equipment such as computers, communication interruption, or operational reasons. In this case, the Foundation notifies the member in advance through the bulletin board on the website. However, if there is an unavoidable reason that the Foundation cannot notify in advance, it may be notified later.
  • ③ The Foundation may provide members with various information deemed necessary while using the service through notices or e-mail. However, members may refuse to receive e-mails at any time, except for transaction-related information and answers to customer inquiries in accordance with relevant laws.
  • ④ In connection with the operation of the service, the Foundation may place advertisements on the service screen, website, and e-mail. A member who receives an e-mail with advertisements can opt-out to the foundation.

  • Article 16 (Change of Service)

  • ① The Foundation may change all or part of the services it provides according to operational and technical needs in cases where there are significant reasons.
  • ② If there is a change in the contents, usage method, and usage time of the service, the reason for the change and the contents of the service to be changed must be posted on the website bulletin board before the change.

  • Article 17 (members' posts)

  • ① The Foundation may delete the contents of services posted or registered by members without prior notice if it is determined that they fall under each of the following items.

  • 1. In case of slander or defamation of other members or third parties by slander
  • 2. In case of violation of public order and morals
  • 3. If it is recognized as being connected to a criminal act
  • 4. In case of infringing other rights such as copyright of the foundation or copyright of a third party
  • 5. In case of exceeding the posting period stipulated by the foundation
  • 6. When a member posts pornography on the bulletin board of the foundation (homepage) or links to a pornographic site
  • 7. If it is judged to be unconstitutional under other related laws

  • Article 18 (copyright of posts)

  • ① The rights and responsibilities of postings rest with the publisher, and the Foundation cannot use them for profit-making purposes other than posting on the site without the consent of the publisher. However, this is not the case for non-commercial purposes, and the foundation has the right to publish on the site.
  • ② Posts posted by members within the service may be exposed in search results, services and related promotions, and may be partially modified, duplicated, edited and posted within the scope necessary for such exposure. In this case, the foundation complies with the provisions of the Copyright Act, and the member can take measures such as deletion of the post or exclusion from search results at any time through the customer foundation or the management function within the service.
  • ③ Members cannot use the data posted on the service commercially, such as processing or selling information obtained using the service.

Chapter 5 Use of Services

  • Article 19 (Prohibition of Objection)
    Users cannot file objections or complaints about any problems that arise when using the services provided by the Foundation.

  • Article 20 (Prohibition of Claims for Damages)
    Users cannot claim damages from the Foundation or related organizations for any problems that arise when using the services provided by the Foundation. The Foundation is not responsible for this.

  • Article 21 (disclaimer)

  • ① The Foundation is exempted from liability for service provision if it is unable to provide the service due to a natural disaster or force majeure equivalent thereto.
  • ② The Foundation is not responsible for any disruption to service use due to reasons attributable to the member.
  • ③ The Foundation is not responsible for the loss of revenue expected by the member using the service, and is not responsible for any other damage caused by data obtained through the service.
  • ④ The Foundation is not responsible for the reliability and accuracy of information, data, and facts posted by members.
  • ⑤ Users are legally responsible for the contents of e-mails sent by members.

  • These terms and conditions are effective from June 07, 2022.
Personal information processing policy information
  • Article 1 (Purpose of Processing Personal Information)
    Personal information is not used for any of the following purposes, and if the purpose of use is changed, we will process it with consent.

  • 1. Provision of Services
    Personal information is processed for the purpose of providing services such as providing NFT content and providing SKYUP COIN information.
  • 2. Civil complaint handling personal information
    Personal information is processed for the purpose of identifying the complainant, checking the complaint, contacting and notifying the results of the processing, etc.
  • 3. Homepage
    In order to provide better services to users, the Sky Up Dragon website automatically collects the following information for statistical analysis to improve and supplement the homepage, and smooth communication between users and websites.

  • 4. Installation of an automatic collection device for personal information

  • Article 3 (Collection and Retention of Personal Information)
    Personal information is collected and held only with the consent of the law and the information subject. Major personal information collected and held based on the provisions of the Act and the period of processing and holding are as follows.

  • 1. Subscribe to the homepage membership
  • - Personal information item: name, date of birth, address, contact number, email, member ID
  • - Holding period: Holding and using from the date of user membership to the time of withdrawal of membership
  • 2. Civil complaint handling
  • - Personal information item: name, address, contact information, email
  • - Holding period: 3 years after completion of civil complaint handling

  • Article 4 (Provision of Personal Information to a Third Party)
    SkyUp Dragon Co., Ltd. processes personal information of an information subject only within the scope specified in Article 1 for the purpose of processing personal information and provides personal information to a third party only if it falls under Article 17 of the Personal Information Protection Act, such as consent of the information subject and special provisions of the law.
  • 1. In the case of obtaining consent as an information subject
  • 2. When there are special provisions in the law or it is inevitable to comply with legal obligations
  • 3. Where it is inevitably necessary to conclude and implement a contract with an information subject

  • Article 6 (Rights and Obligations of Information Subjects and Methods of Exercise)
    (1) The information subject may exercise the right to view, correct, delete, and suspend personal information at any time to Skyup Dragon.
    ② The exercise of rights under paragraph (1) may be conducted through an agent, such as a legal representative of the information subject or a person entrusted. In such cases, a power of attorney under attached Form 11 of the Enforcement Rules of the Personal Information Protection Act shall be submitted.
    ③ Requests for access to personal information and suspension of processing may be restricted under Articles 35 (5) and 37 (2) of the Personal Information Protection Act.
    ④ A request for correction and deletion of personal information cannot be requested if the personal information is specified as the subject of collection in other laws and regulations.

  • Article 7 (Destruction of Personal Information)
    원칙 In principle, if the retention period of personal information has elapsed or the purpose of processing has been achieved, the relevant personal information is destroyed without delay. However, this is not the case if it must be preserved under other laws.
